Is the global war on terrorism related to criminal justice policies and practices adopted here in the United States? How have national policies such as the USA Patriot Act and the use of drones affected policy in local law enforcement agencies here in this country? Yes, the united states’ criminal justice system’s substantive and procedural approaches are related to the global war on terrorism. The criminal justice system has played an essential part in fighting terrorism through respect for human rights and utilizing available resources (Farag, 2020). Also, criminal justice system is focused on developing investigative power, applying technology, counter-terrorism initiative, international cooperation, and formulating evidentiary rules. The department applies human rights and the rule of law in the global fight against terrorists. On the other hand, the united states have applied international laws in terrorism as a foreign affair. Through Congress, the US’s criminal justice has the right to apply international laws to declare war against terrorism or support other states in the fight against terrorism.
Use of international humanitarian laws, international refugee laws, and international human rights, the united states criminal justice system has been able to corporate with other states in dealing with terrorism (Farag, 2020). On the other hand, the criminal justice system has been developing research methods on terrorism, causes, and the main target in the fight of the global war. However, the department has been involved in the identification, capturing, and incapacitation of people who use terrorist tactics. On the other hand, criminal justice focuses on identifying criminals, and protecting borderline are some of the united states’ significant policies and practices. For instance, the united criminal, justice system, monitor, and address acts of violence in airports, respond to a car, and air hijacking protects diplomats from kidnapping and every instruction from attacks through designed policies and strategies (Farag, 2020). The criminal justice system policies are designed to cater to international crimes through actus reus focused on the consequence of kidnapping, bombing, and mass killing, for instance, property damage and death. While and men’s rea is concerned with the mental state of terrorists when conducting the crime, which is identified through conducting research (Farag, 2020).
The USA patriotic act was primarily designed to keep Americans safe from terrorist attacks. The act fosters cooperation and collaboration between local law enforcement and intelligent agencies (De Groot, and Regilme 2020). The law has made a critical impact by using aggressive methods in preventing terrorism over the post facto policies. Through the law, law enforcement works handily with intelligent teams through information sharing and information technology to counter terrorism. During the Barrack Obama administration, the homeland security department’s department received finds for advancing on its tactics for countering terrorism (Farag, 2020). The laws make local law enforcement accountable and functional.
Additionally, drones have been an essential tool in enhancing police methods, practices, and procedures to improve security and fight terrorism (De Groot, and Regilme 2020). Law enforcement agents use drones in conducting surveillance around airports and other areas that may be prone to attacks. The drones capture images and videos on activities that take police on the ground and detect the presence of weapons or any malicious activities through electronic detectors (Farag, 2020).
Yes, I would surrender my liberty for safety because safety comes first (De Groot, and Regilme 2020). Human beings have the right to liberty, for instance, freedom of speech and freedom of privacy under the fourth amendment. On the other side,without security an individual cannot enjoy liberty, live, and carry out productive activities. Without safety, people cannot enjoy freedom; hence it is reasonable to sacrifice freedom for security for long life and opportunities to enjoy liberty.
