Congress likely gave Customs Officers patrolling the waters of the United States significant power in order to effectively combat criminal activity such as smuggling, illegal immigration, and drug trafficking. This power allows Customs Officers to search and seize vessels, make arrests, and conduct investigations without obtaining a warrant. Additionally, this power allows Customs Officers to enforce other federal laws such as fisheries regulations and environmental laws.
A potential authority that could be added to the Maritime Drug Law Enforcement Act is the ability for Customs Officers to board and search vessels without consent in certain circumstances. This would allow Customs Officers to more effectively combat smuggling and drug trafficking, as suspects may be less likely to consent to a search if they are aware of illegal activity on board. Additionally, it could also increase the ability to detect other illegal activities such as human trafficking.
As a Customs and Border Protection Inspector, I would tell the private boat owner that one way he can help the Department of Homeland Security is by keeping an eye out for suspicious activity on the water. This may include vessels that are operating erratically, vessels that are overloaded or in distress, or vessels that are approaching U.S. waters without proper documentation. Additionally, I would inform him to report any suspicious activity to the Coast Guard or other law enforcement agencies immediately.
The United States Navy should have a role in border security on the nation’s ocean borders as they have the capability to provide surveillance, interdiction, and enforcement capabilities in the maritime domain. The Navy can provide assets such as ships and aircraft to monitor and patrol the waters, as well as provide specialized training and equipment to Coast Guard and other enforcement agencies. Additionally, the Navy can provide intelligence and logistical support to other agencies, including facilitating communications and providing equipment for search and rescue operations.
In addition to the United States Coast Guard, other agencies under the Department of Homeland Security that should have a role in port security include the Transportation Security Administration (TSA) and the Federal Emergency Management Agency (FEMA). The TSA is responsible for security of the maritime transportation system, including providing security at ports and terminals. The TSA can provide security screenings of passengers and cargo, as well as conduct security assessments of port facilities. Additionally, FEMA is responsible for responding to disasters and emergencies, and can play a critical role in providing Helpance and support to ports and other critical infrastructure in the event of an incident.
