As a healthcare professional, nurses face numerous ethical dilemmas in their daily practice. One ethical dilemma that I faced during my nursing practice is related to patient privacy and confidentiality. Maintaining patient privacy and confidentiality is one of the fundamental principles of healthcare practice. However, in some situations, nurses face challenges in maintaining patient privacy and confidentiality. In this paper, I will describe an ethical dilemma related to patient privacy and confidentiality that I faced during my nursing practice, the ethical framework that guided my decision-making, the impact of my decision on patient care, myself, and my nursing practice, the impact of HIPAA laws on the ethical situation, and what could have been done differently.

Body:

The ethical dilemma:

During my nursing practice, I was assigned to take care of a patient who was admitted to the hospital for a sexually transmitted disease. The patient was a young adult who had contracted the disease from an unknown partner. When the patient was admitted, he was hesitant to disclose his condition to anyone, including his family. As a nurse, I knew that it was my duty to maintain patient privacy and confidentiality. However, I also knew that the patient’s condition was contagious, and there was a risk of spreading the disease to others. I was faced with an ethical dilemma of whether to breach the patient’s confidentiality to protect others from contracting the disease or to maintain patient privacy and confidentiality.

Ethical framework:

The ethical framework that guided my nursing practice and decision-making in this situation was the American Nurses Association (ANA) Code of Ethics. According to the ANA Code of Ethics, nurses have a duty to maintain patient privacy and confidentiality and to protect patients’ rights to self-determination. However, nurses also have a duty to protect the public from harm. In this situation, my duty was to maintain patient privacy and confidentiality while also protecting the public from harm. What could have been done differently:

Seeking guidance would have helped me to make a more informed decision and to balance patient privacy with public protection more effectively. In addition, I could have educated the patient on the importance of notifying their sexual partner(s) of their condition to prevent the spread of the disease. Education could have empowered the patient to take responsibility for their health and prevent the spread of the disease to others.
